This website is operated by Luyendyk Jewelry. Throughout the site, “I”, “me” and “my” refer to Luyendyk jewelry.
By visiting the site and/ or purchasing something from Luyendyk Jewelry, you engage in the “Service” and agree to be bound by the following terms and conditions. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Luyendyk Jewelry has the right to change the Terms and Conditions and the content of the website at all times.
1. Orders through the webshop
The agreement becomes binding once you place your order. Luyendyk Jewelry will process your order after you have paid. Until then, Luyendyk jewelry will remain the owner of the product(s).
Orders placed through the webshop are custom-made, so materials required to craft the piece are procured immediately to ensure the 6 to 8-week delivery timeframe. Consequently, once your order is submitted, cancellation is not possible.
The production time is 4 to 8 weeks from the moment I receive your ashes or hair strand, and, if applicable, your ring size. If you choose to have your jewelry engraved, please allow an additional 3 weeks for production.
All descriptions of products or product pricing are subject to change at any time without notice.
Luyendyk Jewelry reserves the right to cancel any order you place.
2. Right of withdrawal
The right of withdrawal does not apply to memorial or made-to-measure jewelry. The right of withdrawal also does not apply to wholesale orders. Such pieces cannot be returned or exchanged.
3. Quotes for bespoke commissions
After discussing your custom commission, you will receive a price quote either during your visit or afterward by email. This quote remains valid for two weeks. Upon acceptance, an invoice will be sent for a 10% deposit of the agreed price. All amounts include 21% VAT.
4. Payments
In the webshop, payments can be made using iDEAL, PayPal, Bancontact, or credit card.
5. Shipping
Luyendyk Jewelry ships worldwide. The shipping fee and transit time will depend on your location.
Please send ashes or hair strands securely sealed in a bag. If you request shipment of the finished piece, it will be sent registered and insured via PostNL. You may also collect your item at the atelier.
Taxes and import duties may be applicable to your order. In no way is Luyendyk Jewelry responsible for any customs, taxes or import costs.
Customers provide Luyendyk Jewelry with the delivery address. If the delivery address is found to be incorrect or the customer is not at home when the courier has tried to deliver the package and there are therefore extra costs, the customer will be held responsible and additional costs may be charged to the customer.
Luyendyk Jewelry is not responsible for theft or loss during shipping.
6. Delivery times
Delivery times vary per item due to different techniques and curing processes. Some jewelry may be completed faster than others. If your piece is intended as a gift or you need it by a specific date, please inquire about lead times when ordering.
Delivery times are indicative. Exceeding any delivery period does not entitle the customer to a compensation or claims.
7. Exchanges and returns
Because memorial and breastmilk jewelry are personalized, made-to-order pieces, they cannot be returned or exchanged. The right of withdrawal also does not apply to wholesale orders. If you’re not satisfied with your custom jewelry, please inform me within two weeks so we can explore adjustments together. Any changes may incur costs, which will be communicated in advance.
I produce rings according to the size specified at ordering. If the ring is made correctly but does not fit, any resizing costs are the responsibility of the customer.
No guarantee is offered regarding the texture, color, or pattern of embedded ashes or hair, as these are natural materials. Variations are inherent and expected. Website samples are for illustrative purposes only. Each design is created to make the best possible composition using your materials and engravings. Due to the nature of working with organic substances and creative decisions involved, exact outcomes cannot be predetermined. If the finished piece does not meet expectations, additional adjustment costs may apply.
All items that are altered in size or specially designed and manufactured for you are custom-made and cannot be returned or refunded.
Situations not covered by these terms will be handled in the spirit of these conditions.
8. Warranty
Luyendyk Jewelry pieces are crafted to the highest standards. If an issue arises, please contact me immediately via email or phone to find a solution. I will inform you in advance of any costs if the situation is not covered under warranty.
Customers inspect the delivered products upon arrival and report any defects by e-mail within 7 days upon receiving the products.
In the case of production errors, the item will be repaired or replaced.
Luyendyk Jewelry has the right to decide what solution is most suitable. This may be a repair or replacement.
If Luyendyk Jewelry repairs or replaces an item, this may take up to 10 working days unless otherwise communicated.
It is up to Luyendyk Jewelry to decide whether or not there is a fabrication problem.
A 12-month warranty covers material or manufacturing defects. However, Luyendyk Jewelry reserves the right to charge for repairs if the item has been damaged due to improper handling. If you request repairs or alterations, return shipping cost is your responsibility. Wear and tear is excluded from warranty.
9. Force majeure
If Luyendyk Jewelry is unable to deliver due to force majeure, I am not liable for any resulting loss. Force majeure encompasses any circumstance beyond my control, even if anticipated at the time of agreement, that prevents me from fulfilling the order. I will keep you informed if delays occur or alternative arrangements are needed.
I will treat entrusted materials (ashes, hair strands, etc.) with utmost care. However, I cannot be held liable for damage or loss due to force majeure, including theft, burglary, or shipping loss.
10. Intellectual property
All designs, drawings, calculations, descriptions, texts, photos, models, and other materials provided or created by Luyendyk Jewelry remain its intellectual property. Reproduction or public disclosure without prior permission is prohibited.
